Oil Spill Factors on Land and in Water

There are many factors that may affect a response to an emergency spill, including geographical location, weather conditions, shifting tides or winds, and wild/public life moving through the effected area. These factors differ when faced with land vs. water contamination.

Oil Spill Factors on Land:

  • When an oil spill occurs on land, remote locations with little wildlife or public traffic leave less of a chance that the spill will be disturbed and spread over larger areas.
  • Warmer, wetter weather makes it difficult to control the substances from being absorbed into a larger area of soil. While cold temperature help to contain the spill as it is unable to absorb further into frozen ground.

Oil Spill Factors in Water:

  • Standing water such as marshes or swamps with little water movement are likely to incur more severe impacts than flowing water because spilled oil tends to "pool" in the water and can remain there for long periods of time. In calm water conditions, the affected habitat may take years to restore. Flowing water is less impacted by oil spills because the currents provide a natural cleaning.
  • Biodegradation and dispersing agents both tend to work best in warm water environments.

Environmental Enforcement Act

Emergency oil spills are normally the result of an accident, however under the 'Environmental Enforcement Act' a person can be found at fault of negligence or willful pollution after an investigation of the spill and the following penalties may occur.

Penalties

  • 187. (1) Every individual convicted of an offence under section 186, other than an offence described in subsection (3), is liable,
    • (a) on a first conviction, for each day or part of a day on which the offence occurs or continues, to a fine of not more than $50,000; and
    • (b) on each subsequent conviction,
      • (i) for each day or part of a day on which the offence occurs or continues, to a fine of not more than $100,000,
      • (ii) to imprisonment for a term of not more than one year, or
      • (iii) to both such fine and imprisonment. 2005, c. 12, s. 1 (57).

Same: corporations

  • 187. (2) Every corporation convicted of an offence under section 186, other than an offence described in subsection (3), is liable,
    • (a) on a first conviction, for each day or part of a day on which the offence occurs or continues, to a fine of not more than $250,000; and
    • (b) on each subsequent conviction, for each day or part of a day on which the offence occurs or continues, to a fine of not more than $500,000. 2005, c. 12, s. 1 (57).
